Bureaucratic Work Arounds

Because it is guidance and intended to clarify exisitng regulations, it is not subject to notice and comment requirements of the Administrative Procedures Act. This is a workaround for Agencies that want to extend their power and authority without the interference of Congress. I thought this had been addressed in Sackett v. EPA and West Virginia v. EPA. If Congress didn't specifically give you the power in the written law, you don't have it. Do the courts have to specifically address every damn agency individually?

This one applies to more than gun rights. The Feds have to prove intent in serious regulatory violations. Here a guy overstayed his VISA and unbeknownst to him became a prohibited person. The Feds charged him for possession of a firearm and didn't care that he didin't know he was prohibited. Now they have to.

Fill in the blanks, modify the provided letter to your taste, and hit the send button. Let your friends and family know. If we can't do better than the Brady and Bloomberg minions, well....

Take a moment to let the ATF know your...

...opinion. Actually, that would be counter-productive in this matter. We need to be nice on this one. The comment period for the ATF's new regulation that would require FFL's on the Southwest border ends May 31. If you haven't commented yet you need to do so. John Richardson over at No Lawyers - Only Guns and Money has proved the necessary information to make the process simple. He provides the email address and two letters you can cut and paste or adapt to your needs. Your comment has to be in by May 31st so stop dawdling. I can guarantee you our opponents are doing their best to pack the results. Shouldn't happen. There are more of us than them. Get to it.

The FCC is pushing to...

...regulate the Internet. The market seems to be handling that just fine. Congress and the courts agree. The FCC apparently doesn't. Maybe the Congress can disabuse them of that notion in the new year by, say, cutting their budget.
