We are Winning...

...in the fallout after Bruen. These are mostly District Court level victories like the link below. The cases the Supreme Court remanded back to the Circuit Court have been remanded back to the Disctrict Courts in what I see as a delaying tactic. The liberal Circuit Courts want time to figure out a workaround as they did for the most part in their responses to Heller and McDonald. Whether we will continue to win will be determined by what happens when they reach the Circuits again. This is a knife fight and it ain't gonna be pretty.

Where There's a Will, There's a Way...

...and the D.C. Circuit found a way to approve the ATF's redefinition of a bump stock into a machine gun even though it makes no damn sense, 'cuz gun control is gonna win if they have to gut the law to make it so. Ban the D.C. Circuit, and turf their duties out to the other circuits. Their loyalty is to the bureaucracy not the law.

Supreme Court Vacates Large-Capacity Magazine and Assault Weapon Bans in a Preview of What's Coming Next
As expected, post Bruen a lot of cases are going to have to be reconcidered by the lower courts under the new guidelines. This article gives you a preview. I, personally, think the liberals on the lower courts will just find a way to apply struct scrunity to their advantage. The goal is still too screw gun owners. We will see.

Just as Funny the Second Time

Judge dismisses lawsuit over state's stalled implementation of gun background check initiative
Gun control advocates in Nevada managed with Bloomberg money to barely pass an initiative requiring universal background checks on firearms purchases. Apparently no one bothered to get anyone who had a clue to help draft the initiative. It required the FBI to take part and they said no. the gun control advocates filed suit to force the State to implement the law which was unenforceable as written. The court said no. Lots of Bloomberg money was spent to get the initiative passed for naught. Now more money has been spent to force the State to implement it...for naught.

That's damn funny however you look at it.

It's About Free Speech

Free Speech and Banned Books
This ongoing argument about downloading digital code so you can us a multitude of devices to make firearms is as much a issue of the First Amendment as the Second with the weight going toward the First. The anti's argument seems to be this information is dangerous and digital so its not protected like a book would be. We can ban it. Ummm. OK. The 3-D printing code for the Liberator pistol is now in book form. Let's see how the courts feel about banning that. The stopper is out of the drain guys. You can't put it back in.

Cherry Pick Your Judge and Your Circuit...

...and who knows what the outcome will be. We're long pass the notion that Judges are subject to the Constitution. Sixty years of Miller being used to limit the Second Amendment and ten years of ignoring Heller and McDonald show that.
