Concealed carry, open carry, any damn kind of carry...

...don't do you a whole lot of good if the cops are going to arrest you when you discharge your weapon within city limits. Oh, and it don't matter if it's self-defense because the town ordinance [no discharge of a firearm within city limits] in question has no self-defense exception.

A home owner in Garner surprised a prowler. the prowler shot at him and he returned fire. The police cited the home owner...

...and yes. I understand if the choice is your life or a misdemeanor charge you take the shot. This is bullshit that might cost you your permit or your weapon and you shouldn't have to go through it for defending your life or property.

Update: Details at NC Gun Blog. Appears the the Gardner town ordinance does have a self-defense exemption. The homeowner wasn't shot at and wasn't on his property when he discharged his weapon and so the exemption did not apply and so he was cited. all of which NBC-17 neglected to include in their report.

Update: I have an update posted. It's important. There is an exception for defense of self and property. There's more to the story, but I have to wait until the Town is willing to swear to it before I can release it.

So then the question is why the home owner was cited?

I have a lot of updates on the original post. Short answer is that they don't think he was shooting in self defense of defense of property.
