Blood Dancing in North Carolina

You knew it was going to happen. The Castle Doctrine is under fire in Florida because of the shooting of Trayvon Martin even though it appears it wasn't even a factor in the incident. Now some North Carolina Legislators want to use that tragedy to "revisit" North Carolina's Castle Doctrine. The dogs have simply gotten the scent of blood and are going to do whatever they can to use this opportunity to repeal the recent changes to North Carolina's Castle Doctrine. you know, never let a crisis go to waste. State Rep. Rodney Moore, enjoy your blood dance while you can you worthless piece of trash.

NC: Castle Doctrine

A few months back I posted on SB928: North Carolina's Castle Doctrine. It passed the Senate but was and is being held up in committee by Rep. Deborah Ross (D-Wake). Her excuse was and is that she needed input from leadership on the bill. Well leadership is Hugh Holliman(D-Davidson)who reportedly told constituents he wouldn't do anything to control Ross. Apparently in December he told a local newspaper he supported the Castle Doctrine. I guess we'll have to wait until May when the Legislature goes back in session to really tell but maybe we can make a few phone calls to put a little pressure on him now. Then we'll see. So far the evidence is to the contrary.

In Ireland, new legislation gives...

...homeowners the right to use firearms to defend themselves from intruders.

The police association of superintendents and inspectors, the AGSI, stated that “the current situation, which legally demands a house owner retreat from an intruder, was intolerable".

It’s what amounts to a “castle doctrine”. Meanwhile in North Carolina antigun legislators are holding our castle doctrine bill hostage in committee in the sure and certain knowledge that should it reach the floor it will become law. What does one have to do with the other? Nothing really, except in Ireland where they have no acknowledged right to bear arms, they get it. People have a right to self-defense. To bad certain Democrats in the North Carolina Legislature can't figure that one out.

NC: SB 928 "The Castle Doctrine" held hostage

Senate Bill 928, "The Castle Doctrine", passed in the Senate in May but it sits in a House committee under the thumb of an anti-gun committe chairperson, Rep. Deborah Ross (D-Wake). Paul Valone has the story here. Call your representative and and ask them to do what they can do to shake it loose.

FL: Castle Doctrine under attack

In Florida, a prosecuting attorney wants the Castle doctrine law overturned because it’s making his job more difficult. Alleged bad guys arrested in “gunfights” are using it, successfully, as a defense. Not a good thing but I damn well prefer not to rely on said prosecuting attorney’s good will if I had to shoot some goon to defend my family and home or the rest of the legal profession in civil court should the law be repealed.

I'm actually suprised the legal aspects of this went this smoothly for the victim. Good work on every one's part. In North Carolina the Castle Doctrine applies in your home, vehicle, or place of business. When he attempted to force his way into her car he was toast. I'm sorry she had to do what she did. He got what he deserved.

McKissick on the Castle Doctrine

The State Representative from Durham, Floyd McKissick has a problem with the proposed Castle Doctrine

Durham Democrat Floyd McKissick argued against the inclusion of vehicles, asking what would happen if a nervous driver was approached in a rough neighborhood.

The person knocking on the window might just be a panhandler, a window-washer, or someone asking directions, McKissick said. “But if you’re already apprehensive, you might just decide to shoot ‘em without really wondering about what their true motives are. And once that person’s dead, they’re not going to be able to testify about their intent.

"What if?"Might?" "They'll be blood in the streets..." Those concerns of the possible have been brought up every time in every State where self-defense legislation of this sort has been tendered, and ya know what? It doesn't come to past. The problem here is an assumption by a anti-gun politician that all gun owners are either nervous nellies with a hair trigger, violent sociopaths looking for their first kill, or, well, Representative McKissick and thus incapable of telling the difference between a panhandler and a violent thug intent on breaking into a person's car. Just because you can't manage to tell the difference Floyd don't mean we can't.

North Carolina: House Bill 74

A second Castle Doctrine bill [HB 74] has been introduced in the North Carolina House. What makes it different from Senate Bill 34? It provides not only form protection in the home but in your vehicle as well. It also has a "stand your ground" provision. This bill has the endorsement of Grass Roots North Carolina. The text of the bill and additional information can be found at No Lawyers - Only Guns and Money. All the representatives involved in both bills have my respect, but HB 74 is the better. Call your representatives and ask them to support this version.

Several of the usual suspects...

...in the North Carolina Legislature have introduced HB1192. It's a clear attack on the Castle Doctrine with the intent to reverse many of the hard won gains made in 2011. John Richardson has details here. Unless there is a major change in the make-up of the Legislature its got a snowballs chance in hell of passage. Its just political posturing, but it goes to intent. They won't ever give up, and we can't ever relax.

Community Service

In Charlotte NC, a local thug enters a convenience store armed with a forearm in an attempted armed robbery. The thug jumps the counter and pistol whips the clerk. The clerk defends himself and shoots the thug dead. The Castle Doctrine applies in your workplace in North Carolina. I'd be surprised if there are charges, even in Charlotte.

NC: Restaurant and park carry bill has been delayed...

...in the North Carolina House while pro-gun forces try to get the Ross Amendment removed. The Amendment would allow servers in restaurants to ask customers ordering alcohol if they have a concealed weapon. Deborah Ross, after whom the amendment is named, added the amendment in an attempt to build opposition to the bill. She was responsible for blocking the Castle Doctrine bill in the House last year. Call your representatives and ask them to support the removal of the amendment.

The Aftermath

The Republicans took the House and made gains in the Senate. I hope they don't misread this election. Most of us weren't voting for Republicans. We we voting against Democrats and that's not the same thing.

Unfortunately, Boxer and Reid escaped their deserved fate and we've got six more years before we get another shot at them.

A bit closer to home, I have no representation in the House for another two years. That prick David Price won again showing that a majority in District 4 are OK with extremism as long as its of the leftist variety.

At least Republicans took the North Carolina General Assembly and now, maybe, we can get a few things done starting with a Castle Doctrine and I hope a revamp of our concealed carry. Constitutional carry in North Carolina is probably a pipe dream.

Now lets start thinking of how to toss some more these worthless gits out of office in 2012.

In Raleigh, an armed intruder was shot and killed by the also armed apartment resident. The matter is under investigation. Castle doctrine should prevail.

NC: Castle Doctrine Update

It's out of Committee and we should have a vote int he Senate as soon as tomorrow. This is SB 34 but not as originally introduced. It was amended and now vehicles as well as the home and has a "stand your ground" provision. This makes it a much stronger bill and worthy of our support. John Richardson has more here. ...is an organization intent on using the Trayvon Martin incident to get Castle Doctrine laws repealed nationwide. They are involved in the attempt in North Carolina, HB1192. They are funded by Mayor Michael Bloomberg, and that should tell you all you need to know about the organization.

North Carolina State Senator Eleanor Kinnaird...

...apparently stood up in opposition to S679, Castle Doctrine/Amend Firearms Laws, and went on a rant about jihadis buying assault weapons because of the gun show loophole and the gun lobby and just what that the frack they have to do with providing protections to law abiding citizens forced to use deadly force to protect themselves and or family I don't know but Eleanor Kinnaird and her fellow gun grabbers are there to connect the dots for us.

You gotta wonder what kind of idiot would elect her, but when you google her name you notice her district includes Chapel Hill and suddenly it's all clear.

Woman shoots home invader.

In Fayetteville, North Carolina A home owner was awakened from her nap by the sound of glass breaking. She discovered a man trying to unlock her kitchen window. He yelled at them then fired. She struck one in the chest. Both subjects ran. One was later taken into custody at a local hospital. Both teenagers are in custody. There are no plans to charge the home owner. This is why we have and need a Castle Doctrine.
