Cussing in public...quietly

Over at damnum absque injuria, xrlq discusses North Carolina's law against using profanity in public.

If any person shall, on any public road or highway and in the hearing of two or more persons, in a loud and boisterous manner, use indecent or profane language, he shall be guilty of a Class 3 misdemeanor,

So as long as I walk up to a person, look them in the eye and in a quiet and even voice tell them they're a stupid fuck I'm all good with the "authorities". Right?
